§ 1 Scope
These Terms apply to all contracts between [Provider] and the customer regarding the sale of digital audio plugins via outboard.audio. Deviating terms from the customer are not accepted.
§ 2 Contract parties and payment processing
Payment processing is handled by Lemon Squeezy LLC as the Merchant of Record, which sells in its own name, issues invoices and remits taxes. The contracting party for the purchase transaction is Lemon Squeezy. [Provider] supplies the plugin and the license infrastructure.
§ 3 Conclusion of contract
By clicking the purchase button you submit a binding offer. The contract is formed upon confirmation by Lemon Squeezy. An order confirmation is sent by email.
§ 4 Prices and payment
All prices are in Euros, inclusive of statutory VAT where applicable. Accepted payment methods are displayed in the Lemon Squeezy checkout.
§ 5 Delivery
The products are digital. License data and download links are provided immediately after successful payment, by email and in the customer dashboard.
§ 6 License
You receive a non-exclusive, non-transferable license to use the plugin on up to three (3) devices simultaneously. The full End-User License Agreement (EULA) is included with the plugin installer.
§ 7 Right of withdrawal (consumers)
As a consumer you have a 14-day right of withdrawal from the conclusion of the contract. For digital content this right expires once we begin performance after you have expressly consented and acknowledged that you lose your right of withdrawal (§ 356 (5) BGB). We voluntarily offer a 30-day money-back guarantee from the date of purchase if the plugin does not work as described — requests to support@outboard.audio.
§ 8 Liability
Liability for slight negligence is excluded except for breaches of essential contractual obligations, delay, impossibility, and damages arising from injury to life, body or health. In the event of breaches of essential contractual obligations, liability is limited to typical foreseeable contractual damages.
§ 9 Final provisions
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. If the customer is a merchant, the place of jurisdiction is the seat of [Provider]. Should individual provisions be invalid, the validity of the remaining provisions is unaffected.
